The nature of a will
A Will is a declaration made in accordance with statutory requirements of a person’s intention regarding matters they wish to take effect on or after death. No particular form or wording is necessary but to be valid a will must be;
- in writing
- signed by the testator (the person who made the Will)
- signed by two witnesses to the testator’s signature
- made by a person who has full mental capacity and has not been subject to undue influence
The Granting of Probate
A grant of probate is an official document which the executors may need to administer the estate. It is issued by a section of the court known as the probate registry.
If a person dies without a Will they are known as having died ‘intestate’. Their property and assets will therefore be divided according to the ‘rules of intestacy’.
