Insurance Law – the basics
The Insurance Act 2015 received Royal Assent on 12th February 2015 and, apart from Part 6 of the Act, will come into force on 12th August 2016. It represents the most comprehensive update of the statutory framework of English law for insurance contracts since the Marine Insurance Act 1906.
There are many different types of insurance contract available to manage risk, including:
- life insurance
- personal accident policies
- third party risks (including product liability insurance, professional indemnity insurance, public liability insurance and employers' liability insurance)
- property insurance (this itself includes various categories such as building and contents insurance, landlord’s insurance, restrictive covenant indemnity insurance, flood insurance, property title insurance, contractor's all risks insurance, environmental insurance and goods in transit
- insurance associated with construction and engineering projects
- motor vehicle insurance
- latent defects insurance
Almost all insurance contracts begin with a proposal being submitted by the potential insured/assured to the insurer, and there will often be a cover note and policy document. Usually the parties' rights are governed by the terms of the policy alone, unless another document such as the proposal is incorporated with the policy or if terms are implied by law.
