Mediation - the basics

Mediation is a process by which an independent third party helps parties involved in disputes to find a resolution that is acceptable to all involved. It requires the consent of all parties involved and can take place at any stage of a dispute; both prior to any court proceedings, and during court proceedings.

Mediation is the best known and most popular form of alternative disputes resolution (ADR). Advantages of mediation over litigation/arbitration can include:

  • speed
  • lower costs
  • confidentiality, and
  • control

However,mediation will not be suitable in all cases, particularly if there is a need for:

  • an urgent remedy
  • a test case, or
  • legal enforceability

While the court cannot force parties to settle their differences outside the courtroom, the Court of Appeal has made it clear that the courts can increase a party’s costs through sanctions if they unreasonably refuse to consider other methods of resolving their disputes.

As long as both parties to a dispute are willing to compromise and are keen to settle the case, mediation provides a cost-effective, less stressful way of resolving commercial and civil disputes.
