Bankruptcy law - the basics
Bankruptcy is an insolvency process for individuals, which commences on the day the bankruptcy order is made by the court, following the presentation of a bankruptcy petition.
The making of a bankruptcy order-whether by the court or by the adjudicator-will free the debtor from the debts due to his or her creditors (and will prevent unsecured creditors from commencing, or continuing with, any legal process against the bankrupt or his property). In return, a trustee in bankruptcy (trustee) is appointed in order to divide certain assets of the debtor amongst the creditors (who have a valid and approved claim in the bankruptcy).
The consequences of being made bankrupt
Bankruptcy is not a step to be taken lightly. The consequences can be severe. Bankrupts cannot for example:
- act as a director of a company, or take part in the management, formation or promotion of a company without the leave of the court
- obtain credit (including a mortgage)
- you bank account may be frozen
- you may struggle to get a utilities contract (such as gas, electricity and broadband)
